111/15 MATTERS ARISING:
1. Mrs Parry from Cheshire West and Chester Council Highways department has confirmed
the Parish Council will only have to contribute if it is decided to move the speed limit sign,
highways just need a commitment from the Parish Council before undertaking the
assessment. (minute 102/15(1))
Resolved: It was agreed to officially request an assessment is made to look into
extending the 30mph area on Hollands Lane.
2. Work to fit the second half of the MUGA area has been scheduled for the week starting
the 11th January 2016. (minute 94/15(2)).
3. The CCTV is now up and recording. The Clerk will have the software installed into her
laptop to enable her to view the recordings but we also need some Councillors to be able
to cover for holidays. (minute 94/15(3))
Cllr Mrs Ellis-Taylor, Cllr Lewis and Cllr Harrop volunteered to install the software
onto their systems.
112/15 OPEN FORUM:
Members of the public are invited to speak for no more than 10 minutes to the Council.
1. Unitary Cllr Leather mentioned the proposal to stop giving Parish Councils 20% of the new
homes bonus. The Clerk said the Parish Council had been given a survey to fill out.
2. Unitary Councillor Leather informed the Parish Council that it had been proposed to make
some budget changes within Cheshire West and Chester Council like introducing parking
charges to some car parks that are at present free to use and also it is expected that the
Members Budget will be changed with an expected cutting of funding.

Comment: No comment on the application but have concerns about
delivery and construction vehicles on the access road.

The application to develop the area of land to the rear of numbers 2, 4 and 6 Old Coach Road and adjoin St Phillips Church is not supported by the Parish Council for the following reasons:
Size, mass and location of the two new properties on the area of land that will overlook the existing properties of 2, 4 and 6 Old Coach Road
Impact on the occupants of the existing properties in relation to privacy from the height of the properties
Design of the properties not in keeping with the existing style of build for 2, 4 and 6 Old Coach Road
Access to the site of the development land is too narrow and is an un adopted access serving the existing properties. It is considered too narrow for delivery vehicles and heavy plant equipment that would be used to build the two houses and could result in more cars (from existing residents) being parked on Old Coach Road which would cause some traffic problems.
The actual access to the un adopted road will require widening to ensure vehicles can have a secure turning area without damaging existing walls and hedgerows and also should be upgraded to the standards required for an adopted road.
It is understood that mains water and other services may be located under the access road and that these could be damaged by the weight of delivery vehicles etc.
There are utility poles at the entrance and part way down the access road that may require relocation prior to any development work being started.
In addition there are 3 further major points to our objection:
Central locations for facilities / amenities
Heritage assets
Local character
1. Central locations & facilities for Kelsall
According to NDP policy L3, Central Development location, places within 400m of the village centre are not suitable for further housing but should be used for services such as school, recreation and leisure, retail, healthcare. Therefore this application is not suitable.
If this site is not retained as a private garden by 6, Old Coach Rd, the community would prefer it to be available to the Church for extension to the church buildings to meet the needs of an increasing population within the village from existing approved developments; an extension to the existing burial ground or to the village for uses such as a youth centre.
The NDP is currently at consultation but has not reached the end of Reg14, which seems to be when precedent indicates it has more weight. However there is evidence of public support for the policy arising from the surveys & consultation so far, and there is some claim for 'prematurity'. There are also precedents across the country where NDP’s in this stage of adoption have been supported in their policies.
We would wish to emphasise the national & local policies which support our NDP policies, which are:
NPPF section 3 - supporting a prosperous local economy:
- para 28: "promote retention and development of local services and community facilities in villages such as local shops, meeting places, sports venues, cultural building, public houses and places of worship. This is also written into STRAT8, Rural Area.
The retention of rural shops and community facilities, and the provision of new facilities at an appropriate scale to the settlement, will be supported.
These policies underpin our NDP policy above, and take account of the fact that the village has significantly fewer amenities than other key service centres. This is why it is vital for the sustainability of our community that the few central developable locations be used for community uses. This site, if used as such, would be accessible from Chester Rd and the Community centre car park.
Obviously our policy does not entail commandeering private gardens, however this site has been put forward for development by its owners.
Heritage assets
Local Plan ENV5:
"Development should safeguard or enhance both designated and non-designated heritage assets and the character and setting of areas of acknowledged significance. The degree of protection afforded to a heritage asset will reflect its position within the hierarchy of designations.
Development will be required to respect and respond positively to designated heritage assets and their settings, avoiding loss or harm to their significance etc.
Development which is likely to have a significant adverse impact on designated heritage assets and their settings which cannot be avoided or where the heritage asset cannot be preserved in situ will not be permitted."
Supporting text for this policy says:
8.47 The Council is committed to the protection and enhancement of historic assets. Only in exceptional circumstances where a developer can demonstrate that the need for the development clearly outweighs the need to retain a particular feature and where appropriate mitigation and/or compensatory measures can be provided will permission be granted.
Local Plan Strategic Objective SO12 ties in heritage & local character together:
SO12: Ensure new development is of sustainable and high quality design that respects heritage assets, local distinctiveness and the character and appearance of the landscape and townscape
NPPF on Heritage assets:
131. In determining planning applications, local planning authorities should take account of:
the desirability of sustaining and enhancing the significance of heritage assets and putting them to viable uses consistent with their conservation;
the positive contribution that conservation of heritage assets can make to sustainable communities including their economic vitality; and
the desirability of new development making a positive contribution to local character and distinctiveness.
Point 1 & 2 above, linked to NDP policy - site better used as part of the Church yard to increase church facilities; burial spaces & community facilities
Point 3 - Kelsall does not need 2 more houses of this nature therefore the harm caused by this development is not justified or proportionate.
We would emphasise that applicants normally go to great lengths to point out that their proposals increase the housing supply, however Kelsall's housing supply is doing fine without this proposal!
Local character:
Local Plan ENV6
"Development should, where appropriate:
Respect local character and achieve a sense of place through appropriate layout and design
Provide high quality public realm
Be sympathetic to heritage, environmental and landscape assets"
The church is a listed public building, and the new development would be very visible from the public realm i.e. Chester Rd and the heavily used Community Centre.
Character etc. is all supported by NPPF paragraphs:
58. Planning policies and decisions should aim to ensure that developments respond to local character and history, and reflect the identity of local surroundings and materials
61. Although visual appearance and the architecture of individual buildings are very important factors, securing high quality and inclusive design goes beyond aesthetic considerations. Therefore, planning policies and decisions should address the connections between people and places and the integration of new development into the natural, built and historic environment.
(i.e. this is not just about the look of these houses, but also about where they are & how the whole thing will look & function)
64. Permission should be refused for development of poor design that fails to take the opportunities available for improving the character and quality of an area and the way it functions.
66. Applicants will be expected to work closely with those directly affected by their proposals to evolve designs that take account of the views of the community. Proposals that can demonstrate this in developing the design of the new development should be looked on more favourably. There is no evidence that this has happened with this application.
Excessive scale, out of sync with needs & incomes
From the plans it is also clear that the scale & massing of the proposed properties is totally out of character with the immediate area on Old Coach Road. We have also looked up the site on the Land Registry website and the price paid was £215K, which is well below average property price in Kelsall, so the applicant cannot claim economic necessity to justify the scale.
The NDP consultation has shown that the local preference & housing needs is for medium size 3-bed houses. This is supported in section 5.1 by a raft of statistics showing that Kelsall also has a disproportionate number of very large houses, high rates of under-occupancy, none of which is driven by the incomes or needs of the borough's population (see pages 33-35 of the NDP)
This point is also supported by the Housing policies in NPPF paragraphs 50, 57, and Local Plan strategic objective SO1, and policies SOC1 and SOC3.
Recommendation:
The Parish Council strongly objects to this application for the reasons given above and requests that this application is “called in” should this be necessary.

114/15 OTHER PLANNING MATTERS:
1. The new planning committee is needed for the coming month is Cllr Mrs Britton,
Cllr Mrs Deruty.
2. Cheshire West and Chester new homes bonus fund, Kelsall will receive a sum of £6,681
for the financial year 2015/16. In 2016/17, the Council is proposing to end the payment
of 20% of New Homes Bonus income in this way. The Cheshire West and Chester
Council feel that retaining the funding centrally will allow CW&C to ensure the monies are
better targeted to the areas of greatest need and in line with the Council's priorities. A
questionnaire has been attached.
The Parish Council strongly disagreed that the Council should end the payment of
20% of the new homes bonus that is a valuable source of Parish Council income.
3. The Planning Inspectorate appeal decision on planning application 15/01602/FUL erection
of detached dwelling on site of existing garage and outbuilding, land at Braeside, Waste
Lane, Kelsall. The appeal was dismissed.
115/15 NEIGHBOURHOOD PLAN:
1. Cllr Mrs Britton said the first of the three planned open sessions had taken place and was
very well attended. Cllr Mrs Britton reminded everyone that the NDP survey was per
resident not per householder.
116/15 CLERKS AND CHAIRMAN'S REPORT:
1. The Clerk reported that her printer is going to need replacing soon. It was agreed that the
Clerk can obtain some quotes for a replacement.
2. Cheshire Association of Local Councils planning training course on Tuesday 2nd February
in Crewe. Cllr Nash, Cllr Lewis and Cllr Mrs Ellis-Taylor said they would like to attend.
3. The Clerk reported that she had now received a can of pink chalk based paint from the
Council and had made a start on pink poo campaign. The Clerk and different Councillors
will take it in turns to paint any dog foul in different parts of the village.

114/15 OTHER PLANNING MATTERS:
1. The new planning committee is needed for the coming month is Cllr Mrs Britton,
Cllr Mrs Deruty.
2. Cheshire West and Chester new homes bonus fund, Kelsall will receive a sum of £6,681
for the financial year 2015/16. In 2016/17, the Council is proposing to end the payment
of 20% of New Homes Bonus income in this way. The Cheshire West and Chester
Council feel that retaining the funding centrally will allow CW&C to ensure the monies are
better targeted to the areas of greatest need and in line with the Council's priorities. A
questionnaire has been attached.
The Parish Council strongly disagreed that the Council should end the payment of
20% of the new homes bonus that is a valuable source of Parish Council income.
3. The Planning Inspectorate appeal decision on planning application 15/01602/FUL erection
of detached dwelling on site of existing garage and outbuilding, land at Braeside, Waste
Lane, Kelsall. The appeal was dismissed.
115/15 NEIGHBOURHOOD PLAN:
1. Cllr Mrs Britton said the first of the three planned open sessions had taken place and was
very well attended. Cllr Mrs Britton reminded everyone that the NDP survey was per
resident not per householder.
116/15 CLERKS AND CHAIRMAN'S REPORT:
1. The Clerk reported that her printer is going to need replacing soon. It was agreed that the
Clerk can obtain some quotes for a replacement.
2. Cheshire Association of Local Councils planning training course on Tuesday 2nd February
in Crewe. Cllr Nash, Cllr Lewis and Cllr Mrs Ellis-Taylor said they would like to attend.
3. The Clerk reported that she had now received a can of pink chalk based paint from the
Council and had made a start on pink poo campaign. The Clerk and different Councillors
will take it in turns to paint any dog foul in different parts of the village.

No Youth and Recreation issues were discussed.

1. Sodexo grass cutting quote for 2016 Kelsall Green £91.28 per cut (£89.05 in 2015), Chapel
Green £46.36 per cut (£45.23 in 2015)
Resolved: It was agreed to accept the quote.
